The IBEW lobbied the Senate in support of the Coal Ash Recycling and Oversight Act of 2012 (S. 3512), legislation that would provide for state regulation of coal combustion residuals (CCRs) under Section D of the Resource Conservation and Recovery Act (RCCA). Section D is the section for non-hazardous waste. The bill is a legislative response to a proposal by the Environmental Protection Agency (EPA) to regulate CCRs (coal ash) under either Section C the section for hazardous waste or Section D.
Regulation under Section C will stigmatize the beneficial use of coal ash, ending its use in products such as wallboard (drywall) and Portland cement.

The IBEW continued to lobby Congress to express its support for the new H-2B Prevailing Wage Rule issued by the Department of Labor (DOL). The rule, Wage Methodology for the Temporary Non-Agricultural Employment H-2B Program [76 Fed. Reg. 3452 (January 19, 2011)], is a new rule concerning the calculation of prevailing wage rates applicable to the employment of non-immigrant workers in temporary or seasonal non-agricultural employment.
The new wage rule will help protect the wages and working conditions of employed U.S. workers as well as ensure U.S. workers have a fair opportunity to obtain badly needed jobs.
