Worked specifically on farm bill amendment that would have provided additional resource for producers regarding good depredation problems. Sought support in House Transportation and Infrastructure Committee for HR 4278. Detailed explanation attached.
Section 404(f)(1) exempts activities such as farming, farm ponds, irrigation ditches and farm roads from Section 404 permitting requirements, however, the Environmental Protection Agency (EPA) and the Army Corps of Engineers often interpret the Section 404(f)(1) exemptions in such a way that they are almost entirely negated by the recapture provision in Section 404(f)(2). H.R. 4278 would clarify Congress original intent reiterating that Section 404(f)(1) already says that normal farming and ranching activities are exempt from federal regulation under the CWA and would not allow EPA and the Corps to take away or narrow those exemptions for planting, constructing or maintaining a farm pond, constructing or maintaining irrigation or drainage ditches, or constructing or maintaining farm roads.
Actively engaged association and grassroots in working to prevent EPA from enacting Guidance Document that would effectively remove the word navigable from the Clean Water Act and allow EPA jurisdiction over most waters in Oregon.
