Advocated to extend ARRA FMAP an additional 6 months. Requested House members sign Pingree/Baldwin/Green/Capps Dear Colleague letter requesting full funding of $26.7 billion, $25.5 billion of which is included in the Administrations budget. Also worked with Senate to sign and deliver a similar letter. Requested that the extension be included in JOBS legislation and Extenders legislation.
Requested signatures on letter, to Centers for Medicare & Medicaid Services (CMS) regarding the disproportionate share (DSH) audit rule, that is being circulated by Senator Landrieu (D-LA) and Representative Melancon (D-LA).
a.On December 19, 2008, the CMS issued the final rule for implementing the Medicaid DSH reporting and auditing requirements contained in the Medicare Modernization Act of 2003 (MMA). The rule took effect January 19, 2009
i.The rule alters the definition of uncompensated care to largely exclude traditionally counted elements, such as bad debt and physician services. The policy changes to the Medicaid DSH program, which is a lifeline to many safety-net hospitals across the country, could have a significant negative impact by reducing the amount of DSH payments to these hospitals The DSH allocation for the State of Colorado ranges between $95 million and $100 million per year.
Worked to collect signatures on a letter from House members to CMS urging the agency to make changes to its proposed inpatient prospective payment system (PPS) rule for fiscal year (FY) 2011, specifically the proposed coding offset. This letter is being championed by Reps. Joe Crowley (D-NY) and Pete Sessions (R-TX). Also worked to collect signatures on a similar Senate letter championed by Sen. Stabenow/Murkowski.
a.The proposed rule includes a 2.9 percent cut - $3.7 billion - to recoup half of the payments made in FYs 2008 and 2009 that CMS claims were due to documentation and coding changes that did not reflect real changes in case mix. In combination with other policy changes, this cut will result in hospitals actually being paid less in FY 2011 than in FY 2010. It is anticipated that should this cut move forward, Colorados hospitals will lose approximately $30 million in payments this year.
Worked for support in the Senate for signatures on a letter to CMS regarding provider taxes as allowable expenses on Critical Access Hospitals Medicare cost reports which in the proposed Inpatient Prospective Payment System (IPPS) regulation for Fiscal Year 2011 indicated that this may be eliminated.
