16. Specific lobbying issues
Support the Treasury Department and the Federal Reserve developing and deploy one or more liquidity facilities through which mortgage servicers covering forborne consumer payments can obtain funding to cover potential shortfalls of advances to bondholders and other parties who are compensated from borrower payments during the declared COVID-19 emergency
Support Congress instituting a 36% annual interest rate cap and codifying a ban on confessions of judgments for all small business loans to ensure that small business owners are able to defend their businesses in court in light of the COVID-19 pandemic.
Support provisions included in the next Coronavirus response legislation to protect people's homes, cars, credit, bank accounts and more from evictions/foreclosures, debt collection, car repossessions, predatory lenders, etc
Support the inclusion of the Medical Debt Relief Act (S1581 / HR 6470 Porter) in future covid-19 relief legislation
Support the Treasury directing the SBA to designate returned corporate PPP funds to CDFIs and MDIs to ensure that small businesses of color can access the funds.
Support the inclusion of the credit reporting protections in the HEROES Act in the next COVID-19 relief package, or pass it separately as S. 3508. These protections would establish a temporary moratorium on negative credit reporting for the COVID-19 emergency period plus four months, with the option for consumers to obtain an additional nine months of relief. It would address the looming credit reporting damage from missed bills due to lost jobs or income, which could prevent consumers from getting affordable credit, jobs, housing and more for the next seven years
Support the Senate to include the debt collection protections in the HEROES Act in the next stimulus package in order to protect consumers, nonprofits and small businesses from the most aggressive forms of debt collection so that they can concentrate on getting their families, businesses and the economy back on their feet. In particular, the bill puts a moratorium on:
* evictions and foreclosures
* wage garnishment
* bank account garnishment
* car repossessions
* incarceration for nonpayment of debts, including fees and fines.
Support h. con. Res. 90, to overturn the OCCs rule on the Community Reinvestment Act
Oppose FDICs NPRM regarding Industrial Loan Companies (ILCs). The proposal fails to consider that expansion of ILCs, including those acquired by financial companies, will erode consumer protections and expose consumers to severe harm. Existing ILCs are already disproportionately involved in rent-a-bank partnerships, including very high-cost schemes. New ILCs are likely to attract precisely the high-cost non-bank lenders that want to avoid state laws. The FDIC should crack down on existing ILCs engaged in rent-a-bank schemes and should not approve new ILC charters. [If the FDIC does approve new charters, it should impose severe limitations on the activity of the ILC itself.] No final ILC rule should permit the FDIC to waive the conditions prescribed therein. The high-cost lending that proliferation of ILCs would enable causes severe harm to communities, with a history of causing particular harm to communities of color.

Support the CDC retracting the guidance and instead provide workers with what they need and deserve: critical, enforced safety and health protections; guaranteed paid sick leave for all workers in these sectors; a presumption that infection occurred at work so workers are eligible for workers compensation benefits; and surveillance of workplace incidences of COVID-19 infection.
Oppose the practice of expelling asylum seekers, unaccompanied children, and other migrants to Mexico and other countries under the guise of a March 20 order from the Centers for Disease Control and Prevention on limiting travel at the borders due to COVID-19
Support increased testing and introduce ancillary measures for control of COVID-19.
Support increasing FMAP to states and increasing incentive for states to expand Medicaid. Ensure access to affordable health insurance coverage for all; provide states, localities, and tribes with the financial support they need to respond effectively; protect the health and safety of the health care workforce; organize national public health capacity; and protect all patients access to care and prohibit price gouging of health care services.

Support, at a minimum, the suspension of the issuance of the final Section 1557 of the ACA rule during the current COVID-19 national emergency, the growing economic recession and increasing rates of unemployment. Codification of this rule would lead to discrimination against LGBTQ people

In light of the COVID-19 pandemic, support a nationwide moratorium on juvenile fines and fees - an immediate freeze on new monetary charges and collection of past debt.
Oppose the use of the new PATTERN risk assessment tool, recently developed and authorized under the FIRST STEP Act, as a limiting factor in discretionary determinations about which people in federal prison can and cannot be transferred to Home Confinement during this pandemic
Support the CDC updating their guidelines to include both decarceration and expanding healthcare access for incarcerated people and newly released individuals as vital public health strategies for curbing the virus in and out of facilities, and to save lives
Support the Booker/Jeffries Emergency Community Supervision Act of 2020 that seeks home confinement for those vulnerable and detained in the Bureau of Prisons
Support temporarily lifting the Medicaid Inmate Exclusion Act and provide additional crisis intervention services and supports
Support the Federal Bureau of Prisons including disaggregated data, including the age, race, ethnicity, gender, gender identity, sexual orientation, and disability for incarcerated persons and staff who have contracted, recovered, and died from COVID-19. BOP should also include this same demographic information in its reporting of those it is releasing to home confinement. Additionally, BOP should be reporting the number of people released through compassionate release with demographic information.
Support our courts and policymakers ensuring that our rights and protections are not abridged and that our democracy works for all of us.
Oppose the rapid judicial confirmations of Cory Wilson and Justin Walker who both explicitly support dismantling the healthcare protections we need most right now.
Oppose allowing businesses seeking immunity from potential liability related to workers or customers who contract COVID-19
Support a cessation of the consideration of lifetime judicial nominees at a time when a continued focus on addressing the COID-19 pandemic should be paramount.
Support the inclusion of provisions to protect, release, and support the reentry of incarcerated people in the COVID-19 response package
Support the Emergency GRACE Act to expedite grants of compassionate release by allowing individuals to make direct petitions to the court
Support the Department of Justice opening a full and thorough hate crimes investigation into the horrific killing of Ahmaud Arbery. Also support a federal civil rights pattern or practice investigation into the local district attorneys, including the Office of the District Attorney of the Brunswick Judicial Circuit and the Office of the District Attorney of the Waycross Judicial Circuit, as well as of the Glynn County Police Department, for systemic constitutional abuses.
Support Federal statutory reforms on a range of policing issues, including use of force, police accountability, racial profiling, militarization, data collection, and training.
DOJ should investigate the killings of Breanna Taylor and George Floyd
Call for greater oversight hearing into OJJDP, especially given the guidance pf 5-17-2020, which was contrary to accepted wisdom that juvenile detention is dangerous, retraumatizing, and can expose youth to potential physical and sexual harm
Support HR 7135, legislation to severely curtail the Presidents ability under the 1807 Insurrection Act to use military forces in American cities without explicit Congressional approval
Support the Strong Communities Act would provide grants to attend school or academy to local law enforcement recruits who agree to serve in a law enforcement agency in their community for at least 4 years
Support that there is no statutory cause of action for those who suffer constitutional injury at the hands of federal officers, like there is for those whose rights are violated by state and local officers (section 1983). Instead, victims of federal officers rely on judge-made "Bivens" claims. But the courts have consistently narrowed these claims and the Supreme Court recently threatened their continued existence. Those injured protestors deserve a statutory cause of action to sue those officers who violated their rights--federal officers must be held accountable for police brutality and other violations of constitutional right too. Closing this loophole would help ensure that the executive branch is not above the law.
Support the removal of Section 343 from the Justice in Policing Act. This provision would shield information about officials who engage in racial profiling from the public.
Support an extension of the 30-day comment period for the public to respond to sweeping regulatory changes that the government just proposed for cases involving individuals fleeing persecution in their home countries and seeking safe haven (asylum) in the U.S.
Support whistleblower protections to be included in police reform bills
Support eight priorities which are not only reasonable but reflect a bare minimum of what must be in the Justice in Policing Act for systemic police reform to occur. These priorities are: (1) the creation of a necessary use of force standard that designates force a last resort; (2) a ban on chokeholds; (3) a ban on racial profiling; (4) the establishment of a police misconduct registry; (5) inclusion of a reckless standard in 18 U.S.C. Section 242 that enables federal prosecutors to hold law enforcement accountable for Constitutional violations; (6) a prohibition on no-knock warrants, especially in drug cases; (7) the elimination of the judge-made doctrine of qualified immunity, which allows officers and other government actors to evade accountability when they violate individuals civil rights; and (8) the demilitarization of law enforcement agencies
Support HR 7315, the Protecting Our Protesters Act, which would criminalize police violence against demonstrators exercising their constitutional rights
Support hr 7268 / s 4000, the Andrew Kearse Accountability for Denial of Medical Care Act which would: Hold federal law enforcement officials criminally liable when they fail to obtain or provide medical care to individuals in their custody who are experiencing medical distress; Require training for federal law enforcement officials on assisting individuals in medical distress; and Direct the Inspectors General of the agencies that employ federal law enforcement officers to investigate potential violations and refer appropriate cases to the Department of Justice for prosecution
Oppose s. 3985, the JUSTICE Act, and oppose the motion for the Senate to take the bill up for consideration. The bill is far too weak in terms of Police reform
Support the leadership of the Department of Justice and the Civil Rights Division to empower the career attorneys and staff to do their job in enforcing federal civil rights laws without political interference
Support actions to prevent the continued use and investment in face recognition technology, including by (1) passing legislation, like the Facial Recognition and Biometric Technology Moratorium Act of 2020, which would halt the use of face recognition and prevent federal funds from being used to purchase such technology, (2) stop continued federal funding of invasive and discriminatory technologies by police, including face recognition; and (3) ensure that any policing reform bill that funds body or dash cameras prohibits the use of face recognition used in conjunction with these accountability tools.
Oppose any legislation that would immunize businesses from liability from coronavirus-related claims.

Support a delay in the implementation of the rulemaking process for the proposed regulations implementing the Revised Requirements Under Community Planning and Development Housing Programs (FR-6152) as it may disrupt homeless services and emergency services
Support in-language resources to make sure that consumers with limited English proficiency (LEP) are made aware of their options for COVID-19 hardship assistance, including translated notices and directions on how to request a forbearance, information on how to get in contact with a housing counselor who speaks the consumer's preferred language, and coordinated outreach to LEP communities
Support the Department of Housing and Urban Development (HUD) suspending all non-emergency rulemaking until at least 30 days after the national emergency declared on March 13, 2020 has ended.
Support improved access to forbearance options and comprehensive options for borrowers post-forbearance. Also support improvements in the current loss mitigation protocol. Support HUD for implementing flexible communication policies for forbearance and also for making partial claims the primary means of post-forbearance loss mitigation for those who have recovered from COVID-19 hardships. Support HUD, however, implementing a modification program for those who cannot qualify for a partial claim and also to fix issues with its loss mitigation protocol
Oppose CFPB decision to suspend the reporting of information under the Home Mortgage Disclosure Act (HMDA) during the COVID-19 pandemic. In addition, the decision to eliminate HMDA reporting for more than one thousand lenders removes a critical consumer protection.

Support the Emergency Rental Assistance and Rental Market Stabilization Act which would provide $100 billion in emergency rental assistance.
Support a bill prevents the GSEs and FHA from charging increased fees for people seeking loan refinances or purchase loans when they have inquired about, requested or received a mortgage forbearance
Support FHFA to immediately rescind its mortgage letter requiring a 20% indemnification requirement for validly underwritten loans that goes into forbearance post-closing but before the loan can be insured and for FHFA to rescind its announced penalty of 500-700 basis points on loans similarly situated as these terms create an unnecessarily constricting access to credit
Support hr 6704 / s 4098, the Coronavirus Housing Counseling Improvement Act which authorizes $700 million in housing counseling funding distributed through the NeighborWorks network.
Support hr 7301 the Emergency Housing Protections and Relief Act of 2020. This legislation would authorize about $194 billion in housing aid to homeowners, renters, and people experiencing homelessness, expand moratoriums on foreclosures and evictions, authorize federal loans for rental property owners and mortgage servicers, and offer bankruptcy relief, among other provisions.
