S. 535, S. 128- Energy Efficiency Improvement Act of 2015. BOMA supports the creation of a "Tenant Star" program as it would be free, and establish best practices as well as a voluntary certification system for building tenants to become partners in energy savings.
H.R. 1273- Energy Savings and Building Efficiency Act of 2015, BOMA supports this bill that would require DOE to show a simple payback period of 10 years or less for energy efficiency improvements it suggests get added to the model building code. BOMA supports legislation that maintains that the code is voluntary for states and tribes to adopt either as a whole or by individual provision. BOMA supports a simple payback period that accounts for the financial realities of building ownership.
Data Acquisition- BOMA believes that utilities should be required to provide whole building aggregate data to building owners. In multi-tenant buildings with separately metered tenants, the tenant-not the building owner-owns the energy data. By providing whole building aggregate data, the building owner is able to get the usage information for benchmarking, without violating the tenants' privacy concerns.

S.394 (The Depreciation Fairness Act)/H.R. 765 (Restaurant and Retail Jobs and Growth Act): BOMA supports this legislation that would permanently reduce the timeline to 15 year for depreciated qualified leasehold improvements.
BOMA supports maintaining Section 1031 of the tax code, "Like-Kind" Exchanges, in it's current form. Section 1031 has been an effective economic development tool, stimulation job creation and investment. The policy does not free a tax payer from any obligations to pay taxes, but merely aligns the payments with when the property is sold.
Foreign Investment in Real Property Tax Act: BOMA supports legislation to amend the Internal revenue Code of 1986 to exempt certain stock of real estate investment trusts from tax on foreign investments in United States property interests.
BOMA supports comprehensive tax reform policies that do not penalize capital investment in commercial real estate, do not discriminate against real estate as an investment class, do not retroactively tax embedded invests, revise depreciation schedules to more closely reflect market reality for building components, treat leasehold improvements fairly as a permanent policy- allows depreciation over no longer than a 15-year period, maintain a low tax rate on capital gains and provide a long terms certainly and stability for the economic health and growth of the real estate industry.

BOMA opposes the EPA's plans to promulgate new regulations on post-construction stormwater runoff and exterior lead paint remediation.
BOMA also opposes the EPA and Army Corps of Engineers proposed regulations to redefine "Waters of the United States" as already clearly defined by the Clean Water Act.

H.R. 26: Terrorism Risk Insurance Program Reauthorization Act of 2015. BOMA supports this legislation to extend Terrorism Risk Insurance Act for six years. BOMA believes TRIA supplies a necessary backstop to the reinsurance industry in the event an act of terrorism strikes a commercial property.

H.R. 616, American Entrepreneurship and Investment Act of 2015. BOMA supports immigration legislation that improve visa programs impacting the commercial real estate industry. EB5 visas encourage foreign investment in large commercial projects which ultimately financially benefit the U.S.economy.
