The IBEW testified before the Environmental Protection Agency (EPA) to urge that coal ash be regulated under Subtitle D of the Resource Conservation and Recovery Act. Subtitle D is the section for non-hazardous waste. Others are seeking to have it regulated under Subtitle C, the section for hazardous waste. EPA is considering regulating CCRs in response to the collapse of a coal slurry dam at the Tennessee Valley Authoritys Kingston Fossil Plant in Tennessee.

The IBEW continued to lobby the House and Senate in support of legislation designed to significantly limit an employers ability to deliberately misclassify workers as independent contractors. Unscrupulous employers who wrongfully misclassify employees deprive workers of legitimate protections under federal and state labor laws and cost those same governments billions of dollars in revenue each year. The IBEW supported the Taxpayers Responsibility, Accountability and Consistency Act in the 111th Congress.

The IBEW continued to lobby for the inclusion of Davis-Bacon prevailing wage coverage to any building and construction or infrastructure legislation being considered by Congress. The Davis-Bacon Act requires construction contractors whose projects receive federal funds to pay thier workers no less than prevailing wages and benefits in the area the job is being constructed.

H.R.5476 & S.3079 The IBEW lobbied in support of Building STAR. A package of rebates and financing provisions to quickly put hundreds of thousands of people to work conducting energy efficiency retrofits of commercial and apartment building infrastructure.

The IBEW lobbied to keep the Avondale shipyard in Mississippi open. Northrup Grumman will keep it open until 2016; when its current workload related to the LPD 17 San Antonio-class Amphibious assault ship is complete or close it in 2012 and move the remaining work in Mississippi.

The IBEW sent a letter to Capitol Hill and lobbied in support of the Currency Reform for Fair Trade Act (H.R. 2378). This legislation would allow the President to apply tariffs and countervailing duties on imported products from countries who deliberately manipulate their currency. Goods from countries that deliberately undervalue their currency place American products at an artificial disadvantage in the global marketplace.

In conjunction with the National Electrical Contractors Association, the IBEW sent a joint letter to the U.S. House and Senate opposing any amendments in the Small Business Tax Relief Bill (H.R. 5982) that would repeal the reporting requirements for corporate to corporate services. The Patient Protection and Affordable Care Act requires that businesses who purchase more than $600 in goods or services from a vendor annually report it to the IRS on a 1099 form.
We support the reporting requirements for services but not goods.

The IBEW sent a letter to U.S. Transportation Secretary Ray LaHood in support of an application by the Bay Area Rapid Transit District (BART) for a Transportation Infrastructure Finance and Innovation Act loan for the Oakland Airport Connector (OAC) project. When complete, OAC will extend BART via overhead cable car service to Oakland Airport. Construction of the project would put many IBEW members to work during this, the worst economic downturn since the Great Depression.

The IBEW wrote to Department of Energy Secretary Steven Chu in opposition to Sempra Energys application on behalf of Baja Wind U.S. Transmission LLC (now known as Energia Sierra Juarez U.S. Transmission, LLC) for a Presidential Permit (Docket Number PP-334) to construct a cross-border electric transmission line between northern Baja Mexico and San Diego County, California.
If constructed, Sempras cross-border line would enable the company to build energy projects in Mexico and import electricity into the U.S. instead of building them here where the energy is being used. This will move our economy in the wrong direction at a time when we should be creating jobs here.

The IBEW lobbied Congress to include $18 billion in loan guarantee authority in the Fiscal Year 2010 Supplemental Appropriations Bill for the Innovative Technologies Loan Guarantee Program. The Innovative Technologies Loan Guarantee Program is contained in Title XVII of the Energy Policy Act of 2005. Title XVII provides for federally-backed loan guarantees for any technologies that reduce, avoid or sequester power plant emissions.

The IBEW wrote to Secretary of Commerce Gary F. Locke in support of a funding application (ID #4581) filed with the National Telecommunications and Information Administration by Artic Cable Company to expand broadband infrastructure in western Alaska. The companys proposal, entitled Broadband for the American Arctic, would close a substantial gap in broadband coverage in rural Alaska.
Construction of this new infrastructure would employ IBEW members, many of whom work for Local Exchange Carriers in Alaska.
