S. 761, Energy Savings and Industrial Competitiveness Act of 2013 - BOMA is neutral at this point.
H.R. 2126: Better Buildings Act of 2013 & the 'Tenant Star' program- BOMA supports a fully voluntary program where building tenants may submit their energy data and recieve recognition for their efforts to be energy efficient and environmentally responsible.
BOMA believes that Section 179d of the Internal Revenue Code should be revised to provide enhanced incentives for energy efficiency retrofits to existing buildings.
Data Acquisition - BOMA believes that utilities should be required to provide whole building aggregate data to building owners. In multi-tenant buildings with separately metered tenants, the tenant - not the building owner - owns the energy data. By providing whole building aggregate data, the building owner is able to get the usage information for benchmarking, without violating the tenants' privacy concerns.

BOMA supports a 15-year depreciation period for leasehold improvments.
S. 1163, Fire Sprinkler Incentive Act. BOMA International supports efforts to amend the Internal Revenue Code of 1986 to include automated fire sprinkler system retrofits as section 179 property and classify certain automated fire sprinkler system retrofits as 15-year property for purposes of depreciation.
H.R. 2870 and S. 1181: Real Estate Investment and Jobs Act of 2013 - BOMA Supports this legislation to remove barriers to foreign investment in real estate.

BOMA supports efforts to amend the Americans with Disabilities Act to include a notification and compliance opportunity before a private civil action can proceed. BOMA believes that this will encourage building owners to correct any noncompliance issues and make their buildings accessible to all Americans, while protecting building owners from onerous lawsuits motivated by financial compensation.

S. 394, the Metal Theft Prevention Act of 2013, BOMA supports this legislation because through federal criminal penalties it will create a deterrent against the theft of resalable metals such as copper from commerical buildings, telecommunications lines and infrastructure. BOMA believes this poses a significant life safety issues as well as a financial cost greater than the simple replacement of the stolen metal.

H.R. 508, H.R. 1945, H.R. 2146- BOMA supports the reauthorization of the Terrorism Risk Insurance Act (TRIA) that is set to expire at the end of 2014. BOMA believes TRIA supplies a necessary backstop to the reinsurance industry in the event an act of terrorism strikes a commercial property.

S. 744, The Border Security, Economic Opportunity, and Immigration Modernization Act
BOMA International supports a federal immigration policy that matches willing employers with willing employees. BOMA International favors proposals which improve visa programs impacting the commercial real estate industry and where business owners should not be held responsible for the employees of its subcontractors.

H.R. 2347, Representation Fairness Restoration Act: To amend the National Labor Relations Act with respect to the criteria for determining employee units appropriate for the purposes of collective bargaining.
H.R. 1120, The Preventing Greater Uncertainty in Labor-Management Relations Act
BOMA supports legislation that would prohibit the National Labor Relations Board from taking any action that requires a quorum of the members of the Board until such time as Board constituting a quorum shall have been confirmed by the Senate, the Supreme Court issues a decision on the constitutionality of the appointments to the Board made in January 2012, or the adjournment sine die of the first session of the 113th Congress.
