HR 1194, the Setting Every Community Up for Retirement Enhancement Act (SECURE Act):This legislation would expand access to Open Multiple Employer Plan (MEP) retirement plans and make several changes to ERISA. NAPEO is lobbying for language to be added to the bill passed by the House to prevent the Department of Labor (DOL) from posting the employer participants of PEO-sponsored 401(k) plans on the DOL website.
Implementation of the IRS PEO Certification Program: NAPEO continues to ask the IRS/Treasury to make changes to the PEO Certification Program created by the Small Business Efficiency Act (SBEA), which was contained in the Tax Increase Prevention Act (Public Law No. 113-295). The changes would simplify and streamline compliance with the requirements of PEO certification. NAPEO also works with the IRS to point out problems with the program and to ask questions about compliance on behalf of NAPEO members.

Form 5500 Filings: The Cooperative and Small Employer Charity Pension Flexibility Act (CSEC Act) contains a provision requiring multiple employer plans, or MEPs, to provide a list of participating employers and a good faith estimate of the percentage of total contributions made by each participating employer during the plan year on the plans annual report (Form 5500) for plan years beginning after December 31, 2013. In response, many PEOs redacted, coded, or filed under separate cover the list of their employer plan participants starting with their 2015 Form 5500 filings, on the grounds that these lists are proprietary and trade secrets. Beginning in February 2019, the Department of Labor sent notices of rejection (NORs) to PEOs that had redacted, coded, or sent under separate cover their employer plan participants on their 2016 Form 5500s. NAPEO continues to ask the Department of Labor and the Employee Benefits Security Administration to use its authority to protect the Form 5500 filings of all MEPs from being disclosed to the public.
