Working with EPA on details and requirements of a waiver to section 211(f) of the Clean Air Act for higher blends of ethanol, beyond 10 percent. ACE co-signed the waiver application for E15 which was submitted March 6, 2009.

RFS2 Rulemaking for H.R.6.ENR, Energy Independence and Security Act of 2007; working with EPA on determining how lifecycle greenhouse gas emissions are measured and how such restrictions are applied to ethanol production facilities in the US, and a variety of other issues regarding the implementation of RFS2. Heavy emphasis on how "indirect land use change" will be defined and applied to biofuels.
Conducted a fly-in March 1-3, 2009 with approximately 30 members who made visits to Members of Congress asking for their support on the E15 waiver application and met with Administrator Jackson of EPA.

Supporting the Renewable Fuel Pipeline Act of 2009 (H.R. 864) which would amend the 2005 energy bill to specifically qualify a renewable fuel common carrier pipeline as an eligible project to receive loan guarantees, along with increasing the loan guarantee to 90%.
Supporting the OFS Act of 2009 (H.R. 1476) which would require automobile manufacturers to ensure that not less than 80% of the automobiles manufactured or sold in the United States by each such manufacturer to operate on fuel mixtures containing 85% ethanol, 85% methanol or biodiesel.
Supporting the E85 and Biodiesel Access Act of 2009 (H.R. 1757) which amends the IRS code of 1986 to encourage increased access to alternative fuels. It also raises the amount of the Alternative Fuel Vehicle Refueling Property Credit from 30% of the cost of qualifying property to 50%, but raises the maximum credit to $100,000. And it corrects an IRS interpretation of the credit, which would thereby allow station owners to claim the value for the entire cost of dual purpose fuel dispensers instead of just the E85 portion (would qualify blender pumps).

Providing research and information to the Environmental Protection Agency (EPA) and Congress on the positive impact of biofuels on a future low carbon fuel standard.
Conducted a fly-in March 1-3, 2009 with approximately 30 participants who met with Members of Congress to discuss how PR attacks and negative misinformation about corn and ethanol by opposition groups has unfairly targeted American agriculture. They made Members of Congress aware of how technology innovations in corn and ethanol production allow ethanol to become more sustainable, efficient, and environmentally-friendly at the same time oil becomes more expensive to extract and harmful to the environment. The participants also lobbied to allow up to 15% ethanol to be blended with gasoline.

Asking Congress to resist efforts to harmonize the value of the Volumetric Ethanol Excise Tax Credit (VEETC, commonly referred to as the blenders credit) and the secondary tariff without a commitment to extend VEETC beyond its 2010 expiration date. Participants in the fly-in held March 1-3, 2009 also discussed this in their meetings with Members of Congress.
