The IBEW International Office lobbied the Senate to oppose efforts to weaken Buy America requirements for procurement under the Moving Ahead for Progress in the 21st Century (MAP-21) Act. Specifically, the IBEW opposed efforts to remove Buy America language that requires steel used in highway construction be melted and poured in the United States.
We were successful; MAP-21, as signed by President Obama on July 6, 2012, continues to require that steel used in highway construction be melted and poured in the U.S.

The IBEW continued to lobby the House and Senate against the taxation of employer- provided health insurance. The IBEW is opposed to the recommendation of the U.S. Congress Joint Select Committee on Deficit Reduction to phase-out the healthcare tax exclusion.

The IBEW lobbied Congress to include the Extension of Section 420 and Retiree Life Insurance Act of 2011 in the Moving Ahead for Progress in the 21st Century (MAP-21) Act. As included in MAP-21, this legislation renews Section 420 of the Internal Revenue Code that allows companies with defined benefit plans funded over 125% to use the excess funds to pay for retiree healthcare. In addition, the same excess funding can now be used to pay for retiree life insurance.
The Extension of Section 420 and Retiree Life Insurance Act of 2011 was included in final passage of MAP-21 and signed into law by President Obama on July 6, 2012.

The IBEW continued to lobby Congress in support of the Fair Compliance Act of 2011 (S. 1833), bipartisan legislation to grant coal-fired electric utilities sufficient time to comply with EPAs Cross State Air Pollution Rule (CSAPR) and Mercury and Air Toxics Standard (MATS). The legislation coordinates the implementation date of CSAPR and MATS, grants an additional two years to comply, and requires utilities to submit reports to the appropriate federal agencies regarding their compliance plans.

The IBEW lobbied Congress to include in the Moving Ahead for Progress in the 21st Century (MAP-21) Act language that would greatly restrict the use of an obscure corporate tax break known as a Reverse Morris Trust (RMT). To qualify, a corporation spins-off part of its operations into an unrelated company. If the shareholders of the original corporation control a majority of the voting rights and economic value of the new, merged company then the transaction if tax free.
At a time when the federal government is struggling to find revenue, repealing this tax dodge would assist the U.S. Treasury and middle-class taxpayers. Unfortunately, the IBEW was unsuccessful getting the RMT language included in the final bill.

The IBEW continued to lobby Congress to express its support for the new H-2B Prevailing Wage Rule issued by the Department of Labor (DOL). The rule, Wage Methodology for the Temporary Non-Agricultural Employment H-2B Program [76 Fed. Reg. 3452 (January 19, 2011)], is a new rule concerning the calculation of prevailing wage rates applicable to the employment of non-immigrant workers in temporary or seasonal non-agricultural employment.
The new wage rule will help protect the wages and working conditions of employed U.S. workers as well as ensure U.S. workers have a fair opportunity to obtain badly needed jobs.

The IBEW continued to lobby Congress in opposition to Verizon Wireless application to the Federal Communication Commission (FCC) and Department of Justice (DOJ) for the sale of spectrum and application for approval of joint marketing agreements between Verizon and Comcast Corporation, Time Warner Cable Inc., Bright House Networks LLC, and Cox Communications.
If approved, the loss of competition in the telecommunications industry will result in fewer jobs, less service for consumers, and higher prices for phone, internet, cable television and wireless.

The IBEW continued to lobby against the Trans-Pacific Partnership (TPP) Free Trade Agreement (FTA) in its current form. The IBEW is concerned about secret negotiations surrounding the TPP FTA and the fact its content will not be released until after a final agreement is reached. At that time it will be too late to make changes.

The IBEW continued to lobby against the Computer Professionals Update Act (S. 1747) legislation that would expand the Fair Labor Standards Act (FLSA) exemption for workers involved with computer technology. If passed into law this act would end overtime pay for any worker who uses computer technology in the performance of their duties, no matter how little.

The IBEW lobbied the Senate regarding EPAs proposed new rule for cooling water intake structures. The IBEW supports a rule concerning EPAs proposed impingement standard that would mirror the flexible approach taken in its entrainment standard. Under the proposed entrainment standard EPA chose a method that allows a site-by-site determination of what constitutes best technology available.

The IBEW lobbied Congress in support the McKinley Motion to Instruct Conferees to retain the Coal Residuals Reuse and Management Act (H.R. 2273) as included in the House-passed version (H.R. 4348) of the Moving Ahead for Progress in the 21st Century (MAP-21) Act. H.R. 2273 (Title V of H.R. 4348) was dropped from the final version of MAP-21 during Conference negotiations with the Senate.

The IBEW lobbied the Housing and Urban Development (HUD) Department in support of a review of the bidding process for the City of Galveston (TX) Main Waste Water Treatment Plant. The plant was severely damaged during Hurricane Ike in 2008 and must be rebuilt. Financing is being provided through Community Development Block Grants (CDBGs) from HUDs $3.1 billion fund approved by Congress for Texas following the 2009 disasters caused by Hurricanes Dolly and Ike.

The IBEW continued to oppose efforts to overturn President Obamas Executive Order that encourages the use of project labor agreements (PLAs) on federal construction projects. The IBEW strongly supports the use of PLAs in both the private and public construction. PLAs typically save taxpayer dollars by including accelerated dispute resolution procedures; standards regarding the hiring of local workers and minorities; and apprenticeship training.
