BOMA believes that Section 179d of the Internal Revenue Code should be revised to provide enhanced incentives for energy efficiency retrofits to existing buildings.
Data Acquisition - BOMA believes that utilities should be required to provide whole building aggregate data to building owners. In multi-tenant buildings with separately metered tenants, the tenant - not the building owner - owns the energy data. By providing whole building aggregate data, the building owner is able to get the usage information for benchmarking, without violating the tenants' privacy concerns.

BOMA supports a 15-year depreciation period for leasehold improvments.
BOMA opposes changing the taxable rate of carried interest from the capital gains rate to ordinary income rate.
BOMA supports amending the Internal Revenue Code to allow: (1) 100% expensing in a current taxable year of the cost of an automated fire sprinkler system, as defined by this Act; and (2) accelerated depreciation (i.e., a 15-year recovery period) of such an automated fire sprinkler system that is installed in a building where the floor of any occupiable story is greater than 75 feet above the lowest level of fire department vehicle access.
BOMA supports amending the Internal Revenue Code to classify any qualified energy-efficient cool roof replacement property as 20-year property for depreciation purposes.
FIRPTA - BOMA supports amending the Internal Revenue Code of 1986 to exempt certain stock of real estate investment trusts from the tax on foreign investments in United States real property interests.

BOMA supports amending the Americans with Disabilities Act to include a notification and compliance opportunity before a private civil action can proceed. BOMA believes that this will encourage building owners to correct any noncompliance issues and make their buildings accessible to all Americans, while protecting building owners from onerous lawsuits motivated by financial compensation.
