Form 5500 Filings: The Cooperative and Small Employer Charity Pension Flexibility Act (CSEC Act) contains a provision requiring multiple employer plans, or MEPs, to provide a list of participating employers and a good faith estimate of the percentage of total contributions made by each participating employer during the plan year on the plans annual report (Form 5500) for plan years beginning after December 31, 2013. In response, many PEOs redacted, coded, or filed under separate cover the list of their employer plan participants starting with their 2015 Form 5500 filings, on the grounds that these lists are proprietary and trade secrets. Beginning in February 2019, the Department of Labor sent notices of rejection (NORs) to PEOs that had redacted, coded, or sent under separate cover their employer plan participants on their 2016 Form 5500s. NAPEO continues to ask the Department of Labor and the Employee Benefits Security Administration to use its authority to protect the Form 5500 filings of all MEPs from being disclosed to the public.

Payroll Protection Plan Loans: NAPEO lobbied Congress and the Administration for the following -
* To allow PEOs to apply on behalf of their small business clients for PPP loans.
* To make sure that PEO client employees were not counsolidated with other PEO clients and made ineligible for PPP loans.
* To make sure that PEO clients were not required to use Form 941 to prove payroll when applying for PPP loans.

NAPEO lobbied the following tax issues related to the CARES Act -
* An amendment to make sure that a PEO is not held liable for the non-payment of payroll taxes by a client if the client takes advantage of the provision of the CARES Act that allows a business to delay their payroll taxes for 2020.
* That PEOs can rely on representations made by their client employers with respect to matters related to the FFCRA paid leave credits; the CARES employee retention credit; and the CARES deferral of OASDI taxes.
* Temporary delays - where appropriate - for tax reporting by PEOs on the various credits created by the CARES Act and Families First Act.
* The option for a PEO to support the FFCRA paid leave credits and CARES employee retention credits for specific client employers out of the PEO's aggregate employment tax payments as reported on IRS Form 941.
