H.R.734: To amend the Internal Revenue Code of 1986 to repeal the medical device tax, and for other purposes.
SUMMARY: Repeals the provision of the Internal Revenue Code, added by the Health Care and Education Reconciliation Act of 2010, that imposes an excise tax on medical devices. Rescinds $39 billion of appropriated but unobligated discretionary funds. Exempts unobligated funds of the DOD and VA.
HR 436: Protect Medical Innovation Act of 2011
SUMMERY: Protect Medical Innovation Act of 2011 - Amends the Internal Revenue Code to repeal the excise tax on medical devices.
BIOCOM has been deeply concerned about the negative impact the 2.3 percent ($20 billion) tax will have on employment and the economy in the San Diego region and supports repealing the tax on medical device companies.

S. 23: America Invents Act
SUMMERY: Amends federal patent law. BIOCOM has a keen interest in potential changes to the US patent system which may substantially increase the cost of obtaining patents, increase the risk of challenge to the resulting patents, and consequently reduce the ability of small companies which do so much of the innovative research in this country. BIOCOM is pleased with S 23.
BIOCOM supports the proposed Supplemental examination procedure for presenting to the United States Patent and Trademark Office (USPTO) potentially relevant prior art which was not before the Patent Examiner during the initial prosecution of the patent at issue as a way to begin to address the scourge of charges of inequitable conduct during patent litigation.
BIOCOM also supports the proposed modifications to post-grant opposition; for example, the proposed reduction of the window for challenging recently issued US Patents to nine-months would conform US practice with the established practice of other countries which have a postgrant opposition system. In addition, the enhanced threshold for instituting a post-grant
opposition proceeding will go a long way towards addressing the concern with abusive use of post-grant oppositions.
Additional provisions of S. 23 which put an end to qui tam complaints for alleged false marking, reduce the ability of patent challengers to rely upon an alleged failure to satisfy the best mode requirement, provide the PTO with fee-setting authority and repeal the Baldwin rule are also welcome additions, which BIOCOM supports.
