Submitted virtual comments to the USDA in response to their request for information on the production of biofuel feedstocks using climate-smart agriculture (CSA) practices. Encouraged USDA to continue engaging with Treasury and leverage ACE's Regional Conservation Partnership Program (RCPP) projects to help inform more accurate and updated GHG credit values for CSA practices as the Treasury Department implements the 45Z Clean Fuel Production tax credit under the Inflation Reduction Act (IRA).
Submitted responses to the Supply Chains and Rural America tax teams of the House Ways and Means Committee regarding the 45Z Clean Fuel Production Tax Credit. Encouraged extending 45Z beyond its current sunset in 2027, advocated for regular updates to 45Z guidance based on the best available science and empirical data from ACE-led RCPP projects, urged allowing individual and stacked agricultural practices to qualify toward emission rates for 45Z credits, and urged Treasury and USDA to routinely update eligibility criteria to reflect advancements in agricultural technologies and practices.
Encouraged lawmakers to include a provision for nationwide, year-round E15 in the end-of-year federal funding bill.
Supported S. 3055 and H.R. 6152, the Adopt GREET Act, a bill to require the Environmental Protection Agency (EPA) to update its outdated lifecycle modeling for ethanol and biodiesel, specifically by adopting the latest Argonne National Labs Greenhouse Gas and Regulated Emissions and Energy Use in Transportation (GREET) Model.
Supported S. 944 and H.R. 2434, the Next Generation Fuels Act, bills designed to overcome a host of barriers to the use of higher ethanol blends by creating a new high octane fuel standard, limiting aromatics in gas, ensuring all blends of ethanol receive the same RVP treatment as E10, and requiring future vehicles and retail fuel stations to be compatible with higher ethanol blends, among addressing other regulatory impediments to the deployment of higher octane blends.
Supported S. 785/H.R. 1608, the Consumer and Fuel Retailer Choice Act of 2022, legislation that clarifies E15 should be allowed for sale year-round by extending the 1-psi Reid vapor pressure (RVP) waiver to fuel blends containing gasoline and over 10 percent ethanol.
Supported S. 2707 the bipartisan Nationwide Consumer and Fuel Retailer Choice Act to ensure permanent access to E15 nationwide. Enactment of S. 2707 by Congress will avoid the need to rely on emergency conditions in the market and ad hoc EPA decision making in the future.
