Employee Free Choice Act (EFCA): NJHA opposes this bill because it would change the current union election system that is based on the bedrock principle of democracy: free and fair elections where ballots are cast in private, free from interference or influence by either side. The bill also would mandate onerous first-contract binding arbitration. It would increase the penalties imposed on employers who are found to have committed unfair labor practices during a union organizing drive or negotiation of a first contract.
