H.R. 2454, S. 1462, S. 1733 - Energy and climate change legislation. BOMA supports voluntary incentives for building owners to invest in energy efficiency. BOMA opposes mandated energy efficiency targets for building codes.
S. 3079, H.R. 5476 - Building Star - BOMA supports rebates to incentivize energy efficiency retrofits to existing buildings but opposes the inclusion of Davis-Bacon prevailing wage requirements in this legislation.

H.R. 1935 - To amend the Internal Revenue code of 1986 to provide for the treatment of partnership interests held by partners providing services. BOMA opposes changing the characterization of carried interest in an investment partnership from a capital gain to ordinary income for income tax purposes.
H. R. 4306/S.3510: To amend the Internal Revenue Code of 1986 to permanently extend the 15-year recovery period for qualified leasehold improvement property, qualified restaurant property, and qualified retail improvement property. BOMA supports this legislation.
S. 567 - A bill to repeal the sunset on the reduction of capital gains rates for individuals and on the taxation of dividends of individuals at capital gains rates. BOMA supports repealing the 15% capital gains tax rate sunset provision for individuals and on the taxation of dividends at capital gains rates.
H.R 426 - Green Roofing Energy Efficiency Tax Act of 2009. BOMA supports changing the depreciation schedule to 20 years on any roof system on nonresidential real property which meets the requirements of ASHRAE Standard 90.1-2004.
H.R. 1194 - Fire Sprinkler Incentive Act of 2009. BOMA supports amending the Internal Revenue Code of 1986 to classify automatic fire sprinkler systems as a 5-year property for purposes of depreciation.
H.R. 4213- Tax Extenders Act of 2009. BOMA supports extending the expiring tax provision (including leasehold depreciation and brownfields remediation) but opposes raising the tax on carried interest to finance the tax cuts.

H.R.5569: National Flood Insurance Program (NFIP) Extension Act of 2010-BOMA supports this bill.

BOMA opposes changing the National Labor Relations Act to require the National Labor Relations Board (NLRB) to certify a bargaining representative without directing an election if a majority of the bargaining unit employees have authorized designation of the representative (card check) and there is no other individual or labor organization currently certified or recognized as the exclusive representative of any of the employees of the unit.

Lead-based paint (commercial buildings) - BOMA believes that EPA should not proceed with a rulemaking on lead-based paint in commercial buildings without first establishing the public health risk.
Stormwater Information Collection Request - BOMA believes that EPA should not proceed with a questionnaire to existing sites on stormwater, as (1) developed land, as a category, is not a point source under the Clean Water Act; (2) EPA has no authority to regulate impervious surfaces; (3) releases into municipal separate storm sewer systems (MS4s) are not discharges into waters of the U.S.; and (4) for properties where runoff is channelized and discharged into a water of the U.S., EPA has not met the statutory prerequisites necessary to exercise any regulatory authority over such discharges.
