NCR supported the Secure and Fair Enforcement (SAFE) Banking Act (HR 1996/S.910). Currently, cannabis related businesses do not have access to financial institutions as other domestic industries. The SAFE Banking Act would create a safe harbor for banks to service cannabis industry clients thus enabling cannabis businesses access to checking accounts, lines of credit, and other standard business banking services. Support of SAFE Banking included its inclusion in the National Defense Authorization Act and the end of year omnibus.
NCR also was active on the CLIMB Act (H.R. 8200), a bill that provides safe harbors for financial institutions, government programs, and capital markets. NCR discussed this concept with Senate offices but no Senate companion bill was introduced in the 117th Congress.
NCR further discussed a SAFE "Plus" with House and Senate leadership, which included language relating to federal grants for state and local cannabis-related expungement programs.

NCR supported efforts around the end of year omnibus pertaining to the inclusion of the Secure and Fair Enforcement (SAFE) Banking Act (HR 1996/S.910). NCR further discussed a SAFE "Plus" with House and Senate leadership, which included language relating to federal grants for state and local cannabis-related expungement programs, as it pertained to potential inclusion in the end of year omnibus. Ultimately, no such provisions were included.

Following the Administration's announcement regarding a review of the current Schedule I status of marijuana, NCR discussed the appropriateness of scheduling cannabis and its derivatives under the Controlled Substances Act, including the impacts of moving cannabis to a lower schedule (Schedules II-V), or removing from the list of controlled substances entirely, with staff in the House, Senate, and FDA. NCR expects to continue to weigh in on this policy consideration as it relates to medical utility and consumer safety as the Administration continues its review process. Discussions with House, Senate, and FDA staff also focused on education on the importance of well-tested and well-regulated cannabis products.

As the federal government considers how to reconcile state legal cannabis programs with the federal illegality of cannabis, NCR supported legislation and regulatory paradigms that decriminalize cannabis, remediate the harm of the failed War on Drugs, ensure the highest standards of consumer safety, respect existing cannabis supply chains and provide equitable financial treatment for cannabis businesses.HR 1996, HR 3884 and HR 3105 are the three primary pieces of legislation which NCR has supported to achieve these goals in the 117th Congress. NCR also discussed the potential of the HOPE Act being included in the end-of-year omnibus, which did not ultimately happen. NCR also noted the introduction of the PREPARE Act in the Senate (S.5166) and supported the Medical Marijuana and Cannabidiol Research Act(signed into law)(HR 8454) and the Medical Marijuana Research Act (HR 5657).
