S. 2074- Energy Savings and Industrial Competitiveness Act. BOMA supports the revisions to Section 179d of the Internal Revenue Code to provide enhanced incentives for energy efficiency retrofits to existing buildings that are outlined in this legislation
H.R. 2126, the Energy Efficiency Improvement Act, would create a "Tenant Star" program.BOMA supports this program as it would establish best practices and a volunatary certification system for building tenants to become partners in energy savings.
H.R. 4017 - Smart Energy Act - BOMA supports provisions to establish a loan program for energy efficiency retofits to buildings.
S. 1000 - BOMA International opposes language included in this bill that would set energy efficiency targets for building codes and empower DOE to establish a national building code
Data Acquisition - BOMA believes that utilities should be required to provide whole building aggregate data to building owners. In multi-tenant buildings with separately metered tenants, the tenant - not the building owner - owns the energy data. By providing whole building aggregate data, the building owner is able to get the usage information for benchmarking, without violating the tenants' privacy concerns.

H.R. 4212/S. 749, BOMA supports this legislation that would permanently reduce the timeline to 15 years for depreciating leasehold improvements.
BOMA Supports maintaining Section 1031 of the tax code, "Like-Kind Exchanges", in it's current form. Section 1031 has been an effective economic development tool, stimulating job creation and investment. The policy does not free a taxpayer from any obligation to pay taxes but merely aligns the payment with when the property is sold.
S.1163, Fire Sprinkler Incentive Act - BOMA supports legislation to amend the Internal Revenue Code to allow: (1) 100% expensing in a current taxable year of the cost of an automated fire sprinkler system, as defined by this Act; and (2) accelerated depreciation (i.e., a 15-year recovery period) of such an automated fire sprinkler system that is installed in a building where the floor of any occupiable story is greater than 75 feet above the lowest level of fire department vehicle access.
H.R.2870/ S.1181 - Real Estate Investment and Jobs Act of 2013, FIRPTA - BOMA supports legislation to amend the Internal Revenue Code of 1986 to exempt certain stock of real estate investment trusts from the tax on foreign investments in United States real property interests.

BOMA opposes EPA's plans to promulgate new regulations on post-construction stormwater runoff and exterior lead paint remediation. BOMA also opposes EPA and the Army Corps of Engineers proposed regulations to redefine "Waters of the United States" as already clearly defined by the Clean Water Act.

S. 2244, H.R. 4871, H.R. 508, H.R. 2146 and, H.R. 1945 all seek to extend the Terrorism Risk Insurance Act (TRIA) of 2002. - BOMA supports the reauthorization of the Terrorism Risk Insurance Act (TRIA) that is set to expire at the end of 2014. BOMA believes TRIA supplies a necessary backstop to the reinsurance industry in the event an act of terrorism strikes a commercial property

S. 394, the Metal Theft Prevention Act of 2013, BOMA supports this legislation because through federal criminal penalties it will create a deterrent against the theft of resalable metals such as copper from commerical buildings, telecommunications lines and infrastucure. While the actual replacement cost of the metal is not great, the repair cost to the damaged area can be far greater.

H.R. 3309, the 2013 Innovation Act- BOMA International supports this legislation and other meaningful reforms to curtail patent assertion entities (also known as "patent trolls") from filing unwarranted, vague and frivolous lawsuits.

BOMA opposes action by the FAA to implement new laws or rules that specifically impact local zoning and development. BOMA believes that the federal government must take into account comments, concerns and feedback from all stakeholders.
BOMA support H.R. 4623 which would require the FAA to follow through on a rulemaking process, before rules, which impact local zoning, could be made.
